City, district (city) people's government shall incorporate the work of production safety into the national economic and social development plan and annual plan, and set up special funds for production safety and incorporate them into the fiscal budget. Article 4 The municipal, district (city) safety production supervision and management departments shall conduct comprehensive supervision and management of safety production within their respective administrative areas, and guide, coordinate and urge other relevant departments within their respective administrative areas to perform their duties of safety production supervision and management according to law.
Other relevant departments shall, within the scope of their respective duties, supervise and manage the relevant work safety according to law.
The safety production supervision and management bureau of the economic functional zone is responsible for the supervision and management of safety production in the area under its jurisdiction. Fifth Town People's government, street offices shall determine the safety production supervision and management institutions and safety production supervision and management personnel, and undertake the specific work of safety production supervision and management in this area.
District (city) safety production supervision and management departments may entrust the town people's government, street offices and safety production supervision and management institutions to exercise the following functions and powers:
(a) to enter the production and business units for inspection, access to relevant information, to understand the situation from the relevant units and personnel;
(two) the illegal acts of production safety found in the inspection shall be ordered to make corrections;
(three) the hidden dangers of accidents found in the inspection shall be ordered to be eliminated. Article 6 The municipal, district (city) people's governments and their relevant departments shall ensure that the institutions, personnel, funds and equipment of production safety supervision and management are suitable for the tasks of production safety supervision and management. Seventh city, district (city) people's government and its relevant departments shall establish and improve the responsibility system for production safety.
City, district (city) people's government and its relevant departments are mainly responsible for the work of production safety within their respective administrative areas and departments. Article 8 A production and business operation entity is the main body responsible for production safety, and its main person in charge is the first person in charge of production safety of the entity, who is fully responsible for the work of production safety.
Employees of production and business units have the right to obtain safety production guarantee according to law, and shall fulfill their obligations of safety production according to law. Article 9 Trade unions shall organize employees to participate in the democratic management of production safety according to law, exercise democratic supervision over production safety of production and business units, participate in accident investigation according to law, and safeguard the legitimate rights and interests of employees in production safety.
Industry associations shall, according to the characteristics of the industry, carry out publicity and education on safety production, organize scientific and technological research on safety production, and assist production and business units to do a good job in safety production. Chapter II Safety Management of Production and Operation Article 10 A production and operation entity shall meet the following conditions for safety in production:
(a) the production and business premises, facilities and equipment meet the requirements of laws, regulations and mandatory standards related to production safety;
(two) to establish a responsibility system for production safety, and to have sound rules and regulations and operating procedures for production safety;
(three) the safety investment meets the requirements of safe production;
(four) the establishment of safety production management institutions in accordance with the provisions, equipped with safety production management personnel;
(five) the main person in charge and the safety production management personnel shall participate in the safety production training or pass the examination according to law;
(six) employees have received safety education and training, and special operators have obtained special operation qualification certificates according to law;
(seven) in accordance with the provisions of labor protection articles for employees;
(eight) other conditions for safe production as prescribed by laws and regulations.
A production and business operation entity shall not engage in production and business operation activities if it does not meet the conditions for safe production specified in the preceding paragraph. Eleventh production and business units shall establish the following safety rules and regulations:
(a) the safety production meeting system;
(2) Safety education and training system;
(3) The reward and punishment system for production safety;
(4) Safety management system for facilities and equipment;
(5) Safety production inspection system;
(6) Equipment and management system of labor protection articles;
(seven) the system of investigation and management of hidden dangers of accidents;
(eight) production safety accident reporting and investigation and handling system;
(nine) other rules and regulations to ensure safety in production. Article 12 Units engaged in mining, construction, metallurgy, shipping, road transportation and water transportation, as well as units engaged in the production, management and storage of dangerous goods and units with major hazards (hereinafter referred to as production and operation units in high-risk industries) shall set up safety production management institutions and be equipped with safety production management personnel in accordance with the following provisions:
(1) Where there are more than 300 employees, a safety production management organization shall be set up, and full-time safety production management personnel shall be equipped according to the ratio of not less than 5/1000 employees but not less than 3 employees;
(2) If there are less than 300 employees, a safety production management institution shall be set up or full-time safety production management personnel shall be equipped.
Other production and business operation entities other than those specified in the preceding paragraph shall set up safety production management institutions in accordance with the following provisions, and be equipped with safety production management personnel:
(1) Where the number of employees exceeds 1000, a safety production management organization shall be established, and full-time safety production management personnel shall be equipped according to the ratio of not less than three thousandths of employees;
(2) Where there are more than 300 employees but less than 1000, a safety production management organization shall be set up or at least 2 full-time safety production management personnel shall be equipped;
(three) employees in more than 30 people less than 300 people, equipped with full-time safety management personnel;
(four) less than thirty employees, equipped with full-time or part-time safety production management personnel.
