Regulations of Shanghai Municipality on Trade Unions
Chapter I General Provisions Article 1 In order to safeguard the position of trade unions in the political, economic and social life of the country, clarify their rights and obligations, and give full play to the role of trade unions in the cause of socialist modernization, these Regulations are formulated in accordance with the Constitution of People's Republic of China (PRC), the Trade Union Law of People's Republic of China (PRC) and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 Enterprises, institutions, organs and trade unions within the administrative area of this Municipality shall abide by these Regulations.

Enterprises and institutions established in this city by other provinces and cities shall also abide by these regulations when dealing with the relations with their own trade unions and superior trade unions. Article 3 Trade unions are mass organizations of the working class under the leadership of China. It is the bridge and link between the Party and the masses of workers, an important social pillar of state power, and a representative and defender of the legitimate rights and interests of workers. Article 4 Trade unions must abide by the Constitution and laws, support reform, opening up and socialist modernization, and carry out their work independently in accordance with the articles of association of China Trade Union. And perform the following duties:

(a) while safeguarding the overall interests of the country, safeguard the legitimate rights and interests of workers, care about their lives and serve them wholeheartedly;

(2) Organizing employees to exercise their democratic rights according to law;

(3) Educate employees to improve their ideological consciousness and moral level, so that employees can become workers with ideals, morality, culture and discipline;

(4) Mobilizing workers to actively participate in socialist economic construction;

(five) to organize employees to actively participate in the construction of socialist spiritual civilization;

(6) to assist the people's governments in their work and safeguard the political power of socialist countries. Article 5 Trade unions shall establish an equal consultation and negotiation system with enterprises and institutions according to law, coordinate labor relations, optimize the investment environment and seek common development. Article 6 The legitimate rights and interests of trade unions are protected by law, and no enterprise, institution, organ or individual may infringe upon them. Chapter II Trade Union Organization Article 7 All manual and mental workers whose main source of livelihood is wages in enterprises, institutions and organs have the right to join and form trade unions according to law and the freedom to quit them. Article 8 Trade union organizations at all levels shall be established in accordance with the principle of democratic centralism.

Cities, districts and counties shall establish local Federation of Trade Unions.

In the same industry or industries with similar nature, municipal or district/county industrial trade unions may be established.

If the trade union of an enterprise, institution or organ or several units with similar nature have more than 25 members, a grass-roots trade union committee may be established; If there are less than twenty-five members, an organizer may be elected to preside over the work.

The establishment of a trade union organization must be approved by the trade union at the next higher level.

Any organization that is not established in accordance with the articles of association of the trade union in China shall not carry out activities in the name of the trade union, nor shall it exercise its functions and powers instead of the trade union. Article 9 Enterprises and institutions shall, at the same time as preparing for the establishment, support workers to establish trade unions.

Enterprises and institutions that have started business but have not established trade union organizations shall support and help employees to establish trade unions within six months from the date of opening business.

The trade union at a higher level shall help and guide the employees of enterprises and institutions that have not established trade unions to form trade unions, and enterprises and institutions shall support and provide necessary conditions. Article 10 No unit or individual may interfere with or hinder workers from organizing trade unions according to law, or revoke trade union organizations at will, or assign trade union offices to other departments.

The relevant departments shall urge enterprises and institutions to support workers in establishing trade union organizations when examining and approving contracts and articles of association or conducting registration and labor inspection. For enterprises and institutions that have not established trade union organizations, relevant departments should actively support and cooperate with higher-level trade union organizations and guide employees to establish trade unions. Illegal acts that interfere with or obstruct the formation of trade unions should be corrected according to law. Eleventh grass-roots trade union organizations where the enterprise is terminated, or where the institutions and organs are revoked, the trade union organizations shall be revoked accordingly, and shall be reported to the trade union at the next higher level for the record. Article 12 The trade union committee and the fund review committee shall be elected by the general assembly or the general assembly.

Trade unions at all levels shall set up women workers' committees, and women workers' committees shall be set up if there are less than 25 women members.

The municipal, district and county Federation of Trade Unions may establish legal service institutions to serve employees. Article 13 The chairman and vice-chairman of a trade union shall be elected by the members' assembly or the members' congress, or by the trade union committee, and the term system shall be implemented. Fourteenth city and district, county Federation of trade unions, industrial trade unions, with social organizations as legal persons.

A grass-roots trade union established according to law meets the following conditions, and after being reported to a trade union at the next higher level for the record, it has obtained the legal person status of a social organization:

(a) the establishment of a trade union committee;

(2) Having necessary property or funds;

(3) Having its own name and office space;

(4) Being able to bear civil liability independently.

The chairman of a trade union who has or has obtained the legal personality of a social organization according to law shall be the legal representative. Chapter III Rights and Obligations of Trade Unions Article 15 The municipal, district and county people's governments may take appropriate measures to inform the trade unions at the same level of the government's important work arrangements and administrative measures related to trade union work, and study and solve the opinions and demands of employees reflected by the trade unions.
