Regulations of Liaoning Province on Helping Education and Resettlement of Released Reeducation-through-Labor Personnel
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the relevant laws and regulations of the state and in the light of the actual situation of our province in order to do a good job in the education and resettlement of released prisoners and reeducation-through-labor personnel (hereinafter referred to as released prisoners), prevent and reduce recidivism, and maintain social stability. Article 2 People's governments at all levels should incorporate the work of helping to educate and resettle released prisoners into the comprehensive management of social security as an important part of implementing the leadership responsibility system, and all relevant departments and social forces should cooperate closely to form a joint force.

The comprehensive management department of social security undertakes the organization, guidance, coordination and supervision of the resettlement of released prisoners.

Provinces, cities and counties (cities, districts) set up education associations for released prisoners to assist the comprehensive management departments of social security in their work. Article 3 The main targets of assistance and education placement are those who have no way out of life and are inclined to commit crimes again within three years after being released from prison and released from reeducation through labor. Article 4 Where conditions permit, a foundation shall be established to help educate and resettle released prisoners. Chapter II Assistance and Education Article 5 Prisons and reform-through-labour institutions (institutes) shall, within one month before their release from prison and termination of reeducation through labor, contact the public security organs and receiving units where the ex-prisoners' original accounts are located, introduce their performance in reform and technical training, and hand over relevant files and materials at the time of release from prison and reeducation through labor, so as to continue their assistance and education. Article 6 When released from prison or released from reeducation through labor, the prison and reeducation through labor department shall notify the original unit or their relatives to take it back.

Released prisoners should report to the local police station within ten days and go through the formalities of settlement. Article 7 The police station, village (neighborhood) committee or the unit where the released prisoners are located shall set up a group to help and educate the released prisoners, establish a responsibility system for helping and educating them, and consolidate the achievements of educational reform. Article 8 The members of the assistance and education group shall keep abreast of the ideological trends of released prisoners and find and solve problems in time. Those who are assisted in education should also take the initiative to report their thoughts to the group and the person in charge of helping education.

The families of released prisoners should actively participate in the work of helping and educating. Chapter III Employment Placement Article 9 The employment placement of post-released prisoners shall adopt the methods of combining centralized placement with decentralized placement and combining organizational placement with self-employment. Tenth conditional areas and units should establish resettlement bases or resettlement sites. Encourage individuals to set up bases or resettlement sites for released prisoners.

The government provides policy and financial support to the bases and resettlement sites of released prisoners. Eleventh where the unit has not been released from prison, the original unit is responsible for resettlement; Units that have been delisted and have the ability to resettle should also be resettled. Article 12 Enterprises and institutions shall not discriminate against qualified ex-prisoners when recruiting. Thirteenth to encourage released prisoners to enter the labor market, participate in equal competition and start their own businesses. Fourteenth released prisoners who belong to agricultural registered permanent residence shall be allocated responsibility fields and rations, so that their production and life can be effectively guaranteed. Fifteenth outstanding performance in the education reform and professional skills, should be given priority. Chapter IV Duties of Relevant Departments Article 16 The public security department shall strengthen the management of released prisoners whose bad habits are difficult to reform, the reform effect is poor, and they are prone to recidivism, and severely crack down on recidivists according to law. The police station should establish a responsibility system for helping and educating released prisoners. Article 17 The judicial administrative department shall closely cooperate with the relevant social departments, strengthen the education and targeted business skills training for those who are about to be released from prison and released from reeducation through labor, do a good job in the establishment of transitional resettlement and continuing education organizations for released prisoners, establish a regular inspection and feedback system, and sum up and popularize the experience of helping and educating. Article 18 The labor department shall undertake employment services, actively assist street and township grass-roots organizations to provide employment guidance and skills training for unemployed released prisoners, and take the initiative to do a good job in job introduction. Article 19 The administrative department for industry and commerce shall actively encourage and support ex-prisoners to apply for self-employment, help solve practical problems encountered in their entrepreneurship, guide them to operate legally and practice law-abiding, and improve their professional ethics. Twentieth civil affairs departments should encourage township, street and village (neighborhood) committees to set up entities to resettle released prisoners. Social relief should be given to people who are old and weak, or who have lost their ability to work due to illness, and who have no breadwinner and no source of income. Twenty-first education departments should care about and support the education and professional knowledge education and training of released prisoners. Those who apply for relevant institutions and meet the admission conditions should be admitted. Article 22 Trade unions, the Communist Youth League, women's federations, associations for helping and educating, associations for caring for the next generation, associations of self-employed workers and various social organizations shall, according to their respective characteristics and advantages, care for, support and participate in the work of helping and educating released prisoners. Chapter V Awards and Penalties Article 23 Units and individuals that have made remarkable achievements in helping to educate and resettle released prisoners shall be commended and rewarded by the people's government and the comprehensive management department of social security.
