Article 1 In order to promote the healthy development of private education and safeguard the legitimate rights and interests of private schools and educatees, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) Municipality on the Promotion of Private Education, the Regulations on the Implementation of the Law of People's Republic of China (PRC) Municipality on the Promotion of Private Education and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to the activities of full-time private ordinary middle schools, vocational middle schools, vocational senior middle schools, primary schools, kindergartens and other schools (hereinafter referred to as private schools) within the administrative area of this Municipality. Article 3 Private education is an integral part of education and belongs to public welfare undertakings. People's governments at all levels should incorporate private education into local economic and social development plans, actively encourage, strongly support, correctly guide and manage according to law.

Private schools should implement the national education policy, ensure the quality of education, and devote themselves to cultivating all kinds of qualified talents. Article 4 The municipal education administrative department shall be in charge of private education in this Municipality. The education administrative departments of counties (cities, districts) shall be responsible for the work of private education within their respective jurisdictions in accordance with the division of responsibilities.

The relevant functional departments of the people's governments of cities and counties (cities, districts) shall be responsible for the work of private education within their respective functions and duties. Fifth city and county (city, district) education administrative departments should incorporate private education into the local education development plan.

The compulsory education stage is mainly organized by the government, and private ordinary junior high schools and primary schools can be held moderately, which is strictly controlled by the education administrative department; Encourage the establishment of private high schools, vocational secondary schools, vocational high schools and kindergartens. Article 6 The establishment of a private school shall conform to the requirements of the local education development plan.

The organization, teaching staff, teaching facilities and equipment of the school shall comply with the relevant regulations and standards. Article 7 The establishment of a private school shall have school-running funds suitable for the school's category, scale and teaching requirements, and the school's start-up funds shall comply with relevant regulations. Article 8 Private schools should have relatively fixed, independent and centralized school buildings and venues. The area of school buildings and sites shall meet the prescribed standards.

Change the original function of the building as a teaching place, should be approved by the relevant departments of city planning, public security and fire control. Article 9 The specific conditions and standards for running a private school shall be stipulated by the Municipal People's Government with reference to the conditions and standards of similar public schools at the same level. Article 10 The name of a private school shall indicate its administrative region, school-running level, category or characteristics. Article 11 The establishment of private schools can be divided into two stages: preparation and formal establishment. Those who have the conditions for running a school and meet the set standards may directly apply for formal preparation. Private schools may not enroll students during the preparation period. Article 12 The establishment and formal establishment of private schools shall be subject to grading examination and approval:

(a) full-time ordinary junior high schools, primary schools and kindergartens shall be examined and approved by the education administrative department of the county (city, district) where the school is located and reported to the municipal education administrative department for the record;

(2) Full-time ordinary senior middle schools, vocational middle schools, vocational senior middle schools, complete middle schools or schools with various educational levels such as ordinary middle schools, primary schools and kindergartens, as well as schools with distinctive majors, shall be examined and approved by the municipal education administrative department. Thirteenth city and county (city, district) education administrative departments shall organize the establishment of an expert committee to evaluate the establishment of private schools, and evaluate the application for the formal establishment of private schools to implement academic education. The administrative department of education shall make a decision on whether to approve the establishment of a private school within three months from the date of acceptance according to the conditions, standards and advisory opinions of the expert committee; If the license is not granted, the reasons shall be explained in writing. Fourteenth private schools shall, within one month after obtaining the school license, apply to the civil affairs department at the same level of the education administrative department responsible for examination and approval for legal person registration. Fifteenth public schools approved by the competent administrative department of education, can participate in the establishment of private schools. The reasonable return obtained by public schools belongs to the income of state-owned assets and should enter the financial special account. Sixteenth private schools enjoy the same treatment as public schools with the approval of the people's governments at or above the county level after obtaining the right to use the land and paying the related expenses such as land and construction.

The educational land that private schools have obtained the land use right shall not be used for other purposes. Seventeenth city and county (city, district) people's governments shall set up special funds for the development of private education, finance the development of private schools, and reward and commend the collectives and individuals who have made outstanding contributions.

Special funds shall be managed by the financial department and used after being reported by the education administrative department to the financial department at the same level for approval. Eighteenth education, personnel and other relevant administrative departments shall establish and improve the system to ensure the reasonable flow of teachers between public schools and private schools.

The teaching staff employed by private schools shall register with the administrative department of education for the record, and the teaching experience during the employment period shall be calculated in accordance with the relevant provisions. Nineteenth education and personnel administrative departments shall bring the qualification confirmation and professional title evaluation of teachers in private schools into unified management, and evaluate the professional and technical positions of teachers in private schools according to the same conditions as teachers in public schools. Private schools can set up posts and employ themselves according to the teaching needs. Twentieth private schools should protect the legitimate rights and interests of teaching staff in wages, welfare benefits, paid vacations in winter and summer vacations, business training and so on. , and handle various social insurances such as pension and medical care for faculty and staff in accordance with the law, and pay insurance premiums on time.
