Measures for the Administration of Social Art Level Examination (Order No.31of the Ministry of Culture) Order No.31of the Ministry of Culture

(Adopted at the ministerial meeting of the Ministry of Culture on June 2, 2004, promulgated on July 1 day, 2004, and effective as of July 1 day)

Chapter I General Provisions

Article 1 These Measures are formulated in order to strengthen the management of social art level examination activities, safeguard the interests of candidates, promote the standardization of social art level examination work, ensure the quality of social art level examination work, and promote the healthy development of social art education.

Article 2 The social art level examination (hereinafter referred to as the "art level examination") refers to the activities of the social art level examination institutions (hereinafter referred to as the "art level examination institutions") that have obtained the qualifications in accordance with these Measures to evaluate and guide the artistic level of art learners through examinations.

Article 3 The art grade examination must aim at popularizing art education and improving the quality of the people, follow the laws of art education, adhere to the principles of openness, justice, fairness and voluntary examination, and put social benefits first.

Chapter II Management Organization

Article 4 The Ministry of Culture shall be responsible for the planning, coordination, supervision and management of the national art examination, and perform the following duties:

(a) to organize the formulation and implementation of policies and regulations on art classification;

(two) to formulate the national art grading work plan and determine the total number, layout and structure of art grading institutions;

(3) Examining and approving art grading institutions that carry out art grading activities across provinces (autonomous regions and municipalities directly under the Central Government);

(four) to implement and guide the supervision and inspection of the national art examination activities;

(five) to organize the evaluation of art grading institutions;

(six) responsible for organizing and managing the national social art level examination expert steering committee;

(seven) to coordinate the relevant departments to study and decide on major issues of art grading.

Article 5 The cultural administrative department of the local people's government at or above the county level shall be responsible for implementing the policies and regulations of the national art level examination within its administrative area, and supervising and inspecting the art level examination activities.

The cultural administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for examining and approving the art grading institutions that carry out art grading activities within their respective administrative areas.

Article 6 The National Expert Steering Committee for Social and Artistic Proficiency Examination is an art examination guiding body under the leadership of the Ministry of Culture, and is composed of experts hired by the Ministry of Culture for a term of four years. Its duties are:

(a) to carry out research on policies and regulations related to art examination;

(two) to examine and approve the professional catalogue, standards and syllabus of art examination;

(three) to formulate the qualification standards for art examination examiners, and to examine and approve the qualifications of art examination examiners;

(four) to formulate the qualification standards for art test tutors and guide the training of art test tutors;

(five) to formulate the evaluation criteria for art grading institutions;

(six) to demonstrate the applicant's qualification to run art grading activities, and provide written demonstration results to the examination and approval authority.

Article 7 The National Social Art Level Examination Center is an art examination service institution under the leadership of the Ministry of Culture and the guidance of the National Social Art Level Examination Expert Steering Committee, and performs the following duties:

(a) to publicize the policies and regulations of the art examination and release the information about the art examination;

(two) issued the "social art level examination examiner qualification certificate";

(three) producer "social art level examination certificate";

(4) Organizing and coordinating the training of art test instructors;

(five) organize theoretical research, academic exchanges and exhibitions of art examination.

(six) to complete other tasks assigned by the Ministry of culture.

Chapter III Art Rating Agencies and Examiners

Article 8 Art grading institutions refer to art schools, professional art groups, professional associations and art institutions that have obtained the qualification to offer art grading activities in accordance with the provisions of these Measures.

Article 9 An entity applying for holding art level examination activities shall meet the following conditions:

(1) Independent legal person qualification;

(two) the main business is related to the art examination major applied for, and it has a good artistic academic level and social reputation;

(three) self-compiled and officially published art grading teaching materials;

(four) to apply for the opening of the art examination major, there must be examiners with corresponding majors in the unit, and the examiners in the unit should account for more than two-thirds of the total number of examiners;

(five) there are places and facilities to meet the needs of the art test;

(six) the working institutions responsible for art grading and improving rules and regulations.

Article 10 An application for organizing art level examination activities across provinces (autonomous regions and municipalities directly under the Central Government) shall be submitted to the Ministry of Culture for examination and approval; Applications for holding art level examinations in the administrative areas of local provinces, autonomous regions and municipalities directly under the Central Government shall be examined and approved by the cultural administrative departments of the people's governments of the local provinces, autonomous regions and municipalities directly under the Central Government and reported to the Ministry of Culture for the record.

Article 11 The examination and approval authority shall make a written decision on approval or disapproval within 20 days from the date of accepting the application. If a decision cannot be made within 20 days, it may be extended by 10 days with the approval of the person in charge of the examination and approval authority, and the applicant shall be informed of the reasons for the extension. Approved, issued a "social art level examination certificate"; If it is not approved, it shall explain the reasons in writing.

Before the examination and approval authority makes a decision, it shall submit the applicant's application materials to the expert steering Committee of the national social and artistic level examination for demonstration. The time required for demonstration is not counted in the examination and approval period, but the applicant shall be informed of the time required in writing.

Twelfth units that apply for holding art level examination activities shall submit the following materials:

(1) application. The application shall specify the art examination major to be established, the scope of the examination room, the basic information of the examination institution and its person in charge, the quantity and source of the start-up funds, the charging items and standards, etc. ; The application is signed by the legal representative of the applicant;

(2) Certification documents of legal person qualification;

(three) the composition and working rules of the grading work mechanism;

(four) certification documents of the main person in charge of the grading work organization;

(five) certification documents of the office location of the examination institution and the right to use the examination venue;

(six) self-compiled and officially published art grading teaching materials;

(seven) the materials of the art examination examiner to be hired;

(eight) other relevant materials required by the examination and approval authority.

Article 13 An applicant shall, within 30 days from the date of receiving the Certificate of Social and Artistic Proficiency Examination, apply to the competent price department of the local people's government with the certificate, and file with the Ministry of Culture and the cultural administrative departments of the local people's governments of provinces, autonomous regions and municipalities directly under the Central Government. The administrative department of culture shall issue a record certificate.

The applicant can only start the art examination after obtaining the qualification certificate of social art level examination and the charging license of the local price management department.

Fourteenth art grading institutions do not carry out art grading activities for two consecutive years, and the examination and approval authorities shall withdraw their "Social Art Grading Qualification Certificate".

Where an art grading institution suspends its art grading activities, it shall, within 60 days from the end of the last art grading activity, submit a suspension report to the examination and approval authority and return the qualification certificate for social art grading. If an art grading institution fails to return the Qualification Certificate for Social Art Grading, the examination and approval authority shall cancel its qualification for offering art grading activities.

Fifteenth art examination examiner must obtain the "social art level examination examiner qualification certificate", and be appointed by the art examination institution.

Sixteenth professionals who meet the following conditions may apply for the qualification certificate of social art level examination examiner to the National Social Art Level Examination Expert Steering Committee through the art grading institutions:

(a) 10 years of professional art study experience;

(2) Having more than 5 years' experience in fine arts or fine arts education in applied majors;

(three) have good demonstration, teaching guidance and appreciation ability;

(4) Good political quality and moral cultivation.

Chapter IV Grade Examination Management

Seventeenth art grading institutions must set up a permanent working body, equipped with full-time staff, and organize art grading activities according to the approved art grading majors.

Article 18 Before organizing art grading, art grading institutions may issue grading brochures to the society. The content of the scoring brochure shall not exceed the scope of the major and examination room approved by the examination and approval authority, and the charging items and standards must be marked. Before the release of the scoring rules, it shall be reported to the examination and approval authority for the record, and the examination and approval authority shall issue a record certificate.

Nineteenth art grading institutions may entrust relevant units to undertake art grading activities. The organizer shall meet the following conditions:

(1) Independent legal person qualification;

(two) engaged in art education, art performance, art training, art research and other business related to art examination;

(three) the necessary material conditions for carrying out art grading activities;

(4) Good social reputation.

Art grading institutions must sign a cooperation agreement with the organizers to clarify the rights and obligations of both parties. The organizer must carry out activities in the name of the art classification institution within the scope agreed in the cooperation agreement, and the art classification institution shall bear legal responsibility for the related acts of the organizer.

Article 20 Where an art grading institution entrusts the organizer to undertake art grading activities, it shall, within 20 days from the date when the cooperation agreement comes into effect, report the basic information of the organizer and the cooperation agreement to the Ministry of Culture and the cultural administrative department of the province, autonomous region or municipality directly under the Central Government where the organizer is located for the record. The administrative department of culture shall issue a record certificate.

Twenty-first art marking institutions shall, within 5 days before the start of art marking activities, report the marking time, marking place, the number of candidates and the arrangement of examination rooms. To the examination and approval authority and the cultural administrative department where the art classification activity is located for the record. If the examination room is in a city of a provincial capital (autonomous region or municipality directly under the Central Government), it shall be reported to the cultural administrative department of the province (autonomous region or municipality directly under the Central Government) for the record; If the examination room is in other cities, it shall be reported to the local municipal cultural administrative department for the record; If the examination room is within the county jurisdiction, it shall be reported to the local county (city) cultural administrative department for the record. The administrative department of culture shall issue a record certificate and be responsible for the supervision and inspection of art grading activities.

Article 22 The contents of an art examination shall be determined in accordance with the approved outline of the art examination.

Article 23 Examiners in examination rooms shall be dispatched by art examination institutions. There must be at least 1 examiner in the same examination room.

Examiners who take the examination should hold the Qualification Certificate for Examiners of Social Art Level Examination for inspection.

The examiner can only take the exam in the art grading activities carried out by the employed institutions as stipulated in the Social Art Examiner Qualification Certificate.

Twenty-fourth examiners should evaluate the artistic level of candidates according to the published artistic grade standards, and put forward guiding opinions.

Twenty-fifth examination room to implement the avoidance system. Examiners who are related to relatives, teachers and students who may affect the fairness of the examination should take the initiative to withdraw. Candidates' guardians or underage candidates may apply for the withdrawal of the examiner, which shall be implemented after verification by the person in charge of the examination room. If it should be avoided but not avoided, if it is verified, the inspection result will be invalid.

Twenty-sixth candidates who have passed the submitted art professional level examination shall be issued the corresponding social art level examination certificate by the art examination institution.

Art grading institutions shall, within 60 days after the end of each art grading activity, report the list of art grading certificates to the cultural administrative departments of the local people's governments of provinces, autonomous regions and municipalities directly under the Central Government for the record. The administrative department of culture shall issue a record certificate.

Twenty-seventh art examination institutions employ examiners and their working institutions, the main person in charge, office location changes, should be within 20 days from the date of change, reported to the examination and approval authorities for the record. The examination and approval authority shall issue a record certificate.

Article 28 The Ministry of Culture shall implement an evaluation system for art grading institutions, and the evaluation results shall be announced to the public. Specific measures shall be formulated separately.

Chapter V Punishment Rules

Twenty-ninth unauthorized or disguised artistic grading activities, the cultural administrative department shall order them to stop illegal activities, refund the fees charged, declare the examination invalid, and impose a fine of 30,000 yuan to 10000 yuan.

Thirtieth art censorship institutions have one of the following acts, shall be given a warning by the administrative department of culture, shall be ordered to make corrections, and impose a fine of 3000 yuan to 3000 yuan:

(a) failing to report to the examination and approval authority for the record, that is, issuing the general rules for graded examinations;

(two) the organization of art marking activities is not in accordance with the provisions of the marking time, marking place, the number of candidates, examination room arrangements, etc ... Report to the administrative department of culture for the record;

(three) after the end of the art test activities, the list of art test certificates was not reported to the cultural administrative department for the record;

(four) the main person in charge and the office of the art examination examiner and the examination institution have changed, and they have not filed with the examination and approval authority in accordance with the regulations.

Thirty-first art grading institutions have one of the following acts, the administrative department of culture shall order them to stop grading activities, declare the examination invalid, and impose a fine of 2000 yuan to 5000 yuan; The losses suffered by the candidates shall be compensated by the art examination institutions:

(a) failing to organize art grading activities in accordance with the approved art grading major;

(two) the examiner and his behavior do not conform to the provisions of article twenty-third and article twenty-fourth;

(3) Failing to implement withdrawal as required;

(four) in the process of practicing favoritism and practicing fraud.

Thirty-second art grading institutions have one of the following acts, the cultural administrative department shall order them to make corrections, and give them a penalty of stopping art grading activities 1 year; If the circumstances are serious, cancel the qualification of offering art grading activities and collect the qualification certificate of social art grading;

(a) the entrusted organizer has not filed with the administrative department of culture or the entrusted organizer does not meet the requirements;

(two) issued without producer "social art level examination certificate";

(three) to issue the "social art level examination certificate" to the candidates who have been declared invalid;

(4) expanding the scope of the examination room without approval;

(five) in violation of the charging standards approved by the price management department;

(six) obstructing or resisting the supervision and inspection of the staff of the cultural administrative department.

Thirty-third staff of the cultural administrative department shall be given administrative sanctions if they commit one of the following acts; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(a) in violation of the provisions of these measures, unauthorized approval of unqualified art grading institutions;

(two) do not perform their supervisory duties, illegal acts of art classification institutions will not be investigated;

(3) taking bribes by taking advantage of their authority.

Chapter VI Supplementary Provisions

Article 34 The Ministry of Culture shall be responsible for the interpretation of these Measures.

Article 35 These Measures shall come into force as of July 6, 2004. The Measures for the Administration of Social Art Level Examination issued by the Ministry of Culture on May 6, 2002 shall be abolished at the same time. I. Examination subjects and grades

Sketch, color (watercolor, gouache, oil painting), soft pen calligraphy, hard pen calligraphy, seal cutting, traditional Chinese painting (landscape, flowers and birds, figures), children's painting. Children's painting 1-5, other subjects 1- 10.

Second, candidates

Anyone who loves calligraphy art and has a certain foundation, regardless of age, region, occupation or education level, can sign up for the exam.

Iii. Registration requirements

1, candidates should choose the registration level according to the actual level; 2. The office of each examination area and its subordinate workstations and registration points should guide candidates to choose the registration level to prevent blind reporting; 3. Under the premise that the examination time does not conflict, candidates are allowed to choose two or more subjects; 4. The registration fee is 5-20 yuan for each subject, and the examination fee is 1-5 50 yuan for each subject. For each increase of 6- 10, 1 0 yuan will be added.

Fourth, the application method

1. Candidates who have taken the exam and have a certificate must submit a copy of the original certificate when applying for the exam; 2. Fill in the rating declaration form with correct handwriting or computer printing, complete items and accurate contents. Test area, workstation, name, date of birth, declaration items, declaration level, unit, contact address, contact telephone number, zip code and serial number must be clearly filled in. You must fill in the declaration form for everyone and each object; 3. Three recent bareheaded photos (one admission ticket, one declaration form and one certificate), with the name, subject and grade written in pencil on the back.

The last weekend of each month from August to June, 65438+ February of that year, is the examination time stipulated by the National Examination Committee. The specific examination month shall be determined by the local examination offices, and the test sites shall be tested one month in advance and the examination questions shall be applied. You can only take the exam after approval.

Sixth, the examination requirements

1. Candidates must take the exam according to the time and place shown in the admission ticket and consciously abide by the exam discipline. Those who have no admission ticket or the identity of the admission ticket does not match shall not enter the examination room; 2. Those who have signed up for the exam but failed to take the exam according to the specified time will be abstained and will not go through the formalities of refund and make-up exam; 3. Paper for examination papers Except for children's paintings, which are uniformly distributed by the local examination office, paper and utensils for other subjects must be provided by themselves; 4. Review the papers of works in various subjects according to the evaluation criteria specified in the specification; 5. Calligraphy works must be signed (young candidates, the contents of the examination chapter should be filled in by the invigilator).

Seven, the examination requirements

1, the examination stamp is stamped on the lower right corner of the back of the work; A copy of the original declaration form and certificate is pasted on the back left corner of the work and sent together with the work. Because the copy of the declaration form and the certificate of willingness should be torn off for registration and filing, only one of them can be pasted when pasting, so as not to damage the work when tearing off; 2, the examination staff in the paste declaration form, must be checked; 3. Each examination office (workstation) must make an inventory of candidates' works according to categories and levels, and send the inventory together with the examination papers to the marking center; 4, the declaration form must be stamped with the official seal of the joint; 5. Each examination area must fill in the statistical summary table and the candidate registration form, and send them to the marking center together with the works. The registration form includes the examination area, serial number, name, date of birth, gender, nationality, subject, registration level, unit (school), mailing address, contact telephone number (home) and postal code.

VIII. Review and Certification

1. The examination papers are graded by the experts of the Grade Appraisal Committee of the Painting and Calligraphy Examination Center of China Art Vocational and Technical College according to the actual level of the candidates, and the certificate is issued by the Grade Appraisal Committee of the Painting and Calligraphy Examination Center of China Art Vocational and Technical College. After the test paper is sent to the jury, it can be inquired within 60 days and issued a certificate to the candidates within 80 days; 2. Candidates' papers must be sent within 7 days after the exam, checked within 3 days after receiving the certificate, and distributed to candidates within 15 working days. If in doubt, you must report to the scoring center in writing within 15 working days; 3. Candidates' papers are assessed according to the actual grade, and they are declared to be Grade 3, Grade 8, Grade 8, Grade 2 and Grade 2.
