First, how to deal with kindergarten children being beaten by teachers?
1. If a kindergarten child is beaten by a teacher, parents can complain to the kindergarten and education administrative department in time. If the child is badly beaten, you can call the police. It is definitely illegal for kindergarten teachers to hit children. Even if it does not constitute criminal education, the administrative department can impose administrative sanctions on teachers, and kindergartens can directly dismiss teachers.
2. Legal basis: Article 37 of the Teachers Law of People's Republic of China (PRC).
Teachers in any of the following circumstances shall be given administrative sanctions or dismissed by their schools, other educational institutions or educational administrative departments.
(a) deliberately not to complete the task of education and teaching, resulting in losses to education and teaching;
(two) corporal punishment of students, the education is invalid;
(three) bad conduct, insulting students, bad influence.
If a teacher falls under any of the circumstances listed in Items (2) and (3) of the preceding paragraph and the circumstances are serious enough to constitute a crime, he shall be investigated for criminal responsibility according to law.
Second, is it illegal for teachers to punish students physically?
The teacher's corporal punishment of students violated the relevant laws of People's Republic of China (PRC) Law on the Protection of Minors, People's Republic of China (PRC) Law on Compulsory Education and People's Republic of China (PRC) Law on Teachers.
Article 21 of the Law of People's Republic of China (PRC) on the Protection of Minors
Teachers and staff in schools, kindergartens and nurseries shall respect the personal dignity of minors, and shall not impose corporal punishment on minors, corporal punishment in disguised form or other acts that insult their personal dignity.
Article 63
School, kindergarten, nursery staff corporal punishment, corporal punishment of minors or other degrading behavior, by their units or higher authorities shall be ordered to make corrections; If the circumstances are serious, it shall be punished according to law.
Article 29 of the Compulsory Education Law of People's Republic of China (PRC)
Teachers should respect students' personality, and must not discriminate against students, and must not punish students with corporal punishment, corporal punishment in disguised form or other acts that insult their personal dignity, or infringe upon their legitimate rights and interests.
