Interim Measures of Qingdao Municipality on the Safety Management of School Bus

Article 1 In order to strengthen and standardize the management of school buses, prevent and reduce school bus traffic accidents, and effectively ensure the traffic safety of students going to and from school, these measures are formulated in accordance with the provisions of the Road Traffic Safety Law of the People's Republic of China, the Compulsory Education Law of People's Republic of China (PRC), and the Measures for the Safety Management of Kindergartens in Primary and Secondary Schools of the Ministry of Education, combined with the actual situation of our city.

Article 2 These Measures shall apply to kindergartens, ordinary primary and secondary schools, secondary vocational schools, special education schools and other educational institutions (hereinafter referred to as schools) that use school buses to pick up and drop off students within the administrative area of this Municipality.

Article 3 The term "school bus" as mentioned in these Measures refers to buses with more than 7 seats owned or leased by the school for more than one year and used to pick up and drop off students and their caregivers.

Vehicles carrying less than 7 passengers shall not be used as school buses.

Article 4 The school authorities shall be responsible for guiding and supervising the school to perform the duties of school bus safety management as stipulated in these Measures, and incorporate the implementation of school bus safety into the year-end assessment of safety management.

The public security traffic management department is responsible for the safety supervision of school bus operation, issuing school bus identification cards, implementing management measures for school buses and their drivers, and cooperating with schools to regularly educate school bus drivers and school teachers and students on traffic safety.

The traffic management department is responsible for the qualification supervision of passenger transport enterprises engaged in school bus operation, and put an end to non-operating vehicles to pick up students. Optimize bus routes to facilitate students to ride.

The safety supervision department is responsible for supervising and assessing the implementation of school bus safety management responsibilities by relevant departments.

Fifth school departments and public security traffic management departments shall establish a school bus safety management information notification system and regularly study school bus management measures.

Article 6 Students in areas with convenient public transport are encouraged to take public transport to and from school.

Article 7 A unified marking system shall be implemented for school buses.

The school bus should be placed in the lower right corner of the windshield and the appropriate position of the rear windshield. School-owned school buses should be painted with uniform appearance signs.

The appearance identification of the school bus is determined by the municipal public security traffic management department in conjunction with the municipal education administrative department.

Article 8 As a school bus, a motor vehicle shall meet the following conditions:

(a) registered in this city;

(two) in line with the national standards for motor vehicle operation safety technology, and passed the inspection by the public security traffic management department;

(three) to participate in motor vehicle traffic accident liability compulsory insurance, driver and passenger insurance, carrier liability insurance;

(4) The driver has more than 5 years of driving experience and more than 3 years of safe driving experience, continuously drives the same vehicle as the school bus for more than 1 year, and the traffic violation score in the last 3 years has not reached 12, and there is no responsibility for causing death accidents.

If the school rents a motor vehicle, the owner of the motor vehicle shall have the qualification to engage in road passenger transport business.

Article 9 If a school owns or rents a vehicle as a school bus, it shall go through the filing formalities with the competent department of the school. When filing, the filing application, motor vehicle inspection certificate, compulsory insurance policy and other materials shall be submitted, and the name certificate of passenger transport enterprise, lease contract and other materials shall also be submitted for renting school buses. The filing application shall specify the vehicle number, driving route, stop site, number of students, drivers and vehicle management personnel.

The school administrative department shall, within 5 working days from the day after receiving the application, confirm the ownership and use right of the vehicle. After confirmation, the school shall apply to the public security traffic management department for the school bus sign. The public security traffic management department shall verify it within 5 working days and issue school bus signs. If the verification is unqualified, the applicant shall be informed in writing of the reasons.

Tenth school bus sign holders in any of the following circumstances, shall go through the formalities for alteration or cancellation to the original filing authority:

(1) Adding or changing school bus drivers;

(2) adding or changing service schools;

(3) changing the use of the school bus.

The self-provided school bus under the circumstances specified in item 3 of the first paragraph of this article shall be cancelled at the same time.

Eleventh schools organize students to participate in spring (autumn), summer (winter) camp tourism or other collective activities, and need to temporarily rent motor vehicles without school bus signs to pick up students, it should be filed with the local school authorities and public security traffic management departments 10 days in advance.

The contents of filing shall include time, reason, number of teachers and students, destination, driving route, leader, person in charge of safety, safety activity plan, vehicle type, quantity, owner, vehicle inspection report, vehicle insurance policy, driver qualification review report, lease contract, etc.

Twelfth shall not be altered, forged and transferred, and shall not be used for other motor vehicles.

Thirteenth the establishment of school bus safety management target responsibility system. School departments and public security traffic management departments should sign responsibility letters for school bus road traffic safety management with schools, schools should sign responsibility letters for safe driving with school bus drivers, and schools should sign responsibility letters for safety with rental units to implement road traffic safety responsibility one by one.

Fourteenth school bus owners and managers should implement the laws, regulations and rules of school bus safety management, establish and improve the school bus safety responsibility system and safety inspection system, and ensure that school buses and drivers meet operational requirements.

School bus drivers should abide by the provisions of road traffic safety laws, regulations and rules, and drive safely in accordance with operational norms.

Fifteenth schools should formulate emergency plans for school bus emergencies and implement safety early warning mechanisms. Clarify the start of emergency plan after school bus traffic accident, the handling of casualties, accountability and reporting system.

If a school bus accident causes student casualties, the school shall promptly report to the superior competent department and the public security traffic management department; In the event of a major accident, the school authorities shall immediately report it step by step in accordance with the relevant provisions, and work with other departments to deal with the accident and deal with the aftermath.

Article 16 Schools and vehicle owners who rent school buses shall establish school bus management accounting systems respectively to truly record the safety maintenance of vehicles, drivers and students.

Seventeenth school bus owners should do a good job in the safety maintenance of school buses. For school buses with more than 20 seats, carry out 1 secondary maintenance every 3 months; School buses with less than 19 seats should be maintained 1 time every six months.

It is forbidden for vehicles to go on the road with faults.

Eighteenth schools should designate a person to be responsible for the safety management, safety inspection and safety education of school buses, and set up management personnel to be responsible for the safety of students getting on and off the bus and driving. School buses for junior high school and kindergarten students should be equipped with at least two caregivers.

Before the school bus picks up students, managers should check the safety status of the school bus, the number of students picked up and the status of drivers.

Nineteenth the number of school buses to pick up students and caregivers shall be determined according to the number of school bus signs, and shall not be overloaded.

The school bus should be equipped with fire extinguishers and other emergency rescue equipment.

Twentieth district school authorities and public security traffic management departments shall report the safety management of school buses in the previous year to the municipal school authorities and public security traffic management departments before 12+00 every year. The annual school bus safety management of schools directly under the municipal government is directly reported to the municipal school department and the public security traffic management department by the municipal school department.

Twenty-first school bus applicants in violation of these measures, by cheating and other improper means to obtain school bus signs, the registration authority to recover the school bus signs.

Article 22 If a school uses a motor vehicle that has not obtained the school bus identification number plate to pick up and drop off students or the school bus changes its use without going through the relevant formalities with the filing authority, the competent department of the school shall punish the person in charge of the school according to the seriousness of the case.

Twenty-third schools do not perform the duties of school bus safety management, and fail to take timely measures for major safety hazards, resulting in serious consequences, the school authorities shall give sanctions to the person in charge of the school according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 24 If the staff of education, public security, transportation, safety supervision and other departments fail to perform school bus management duties as required, resulting in serious consequences, the relevant departments shall give administrative sanctions to the main person in charge of the unit and the person directly responsible; If a crime is constituted, criminal responsibility shall be investigated according to law.

Twenty-fifth vehicles that have been used as school buses before the implementation of these measures shall go through the application procedures for school bus signs within 30 days from the date of implementation of these measures.

Article 26 These Measures shall come into force on June 5438+February 2, 2007, and shall be valid until June 5438+February 2, 2065438/kloc-0.
