Regulations on Election of Villagers' Committees in Sichuan Province (revised in 2020)
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Organic Law of Villagers' Committees of the People's Republic of China and in the light of the actual situation in Sichuan Province in order to standardize and improve the election system of villagers' committees, ensure the villagers to conduct democratic elections according to law and strengthen the construction of villagers' committees. Article 2 Villagers' committees are directly elected by villagers. The election shall adhere to the principles of openness, fairness and impartiality, and implement differential election and secret ballot. No organization or individual may designate, appoint or replace members of a villagers' committee. Article 3 A villagers' committee consists of a chairman, vice-chairmen and three to seven members. The specific amount and post setting of its members shall be discussed and decided by the villagers' meeting or the villagers' representative meeting according to the actual situation of the village. There should be women members in the members of villagers' committees, and there should be ethnic minority members in the villages where multi-ethnic villagers live. There shall be no close relatives among the members of the villagers committee. Article 4 The term of office of a villagers' committee is five years, and a general election shall be held at the expiration of the term. Members of villagers' committees may be re-elected.

If it is necessary to advance or postpone the general election due to special circumstances, the people's governments of townships, nationality townships and towns shall, after discussion and consent by villagers' meetings or villagers' representative meetings, report to the people's government at the county level for approval and report to the Standing Committee of the people's congress at the same level for the record. The civil affairs departments of local people's governments at or above the county level shall be responsible for the daily work of the election of villagers' committees within their respective administrative areas. Sixth local people's congresses at or above the county level and their standing committees and the presidium of the people's congresses of townships, nationality townships and towns shall supervise the election of villagers' committees according to law. Chapter II Election Organization and Duties Article 7 During the general election of villagers' committees, local people's governments at all levels shall set up a steering group for the general election of villagers' committees, which shall be responsible for organizing and implementing the general election of villagers' committees within their respective administrative areas, and its members shall be composed of the people's governments at the same level and the heads of relevant departments. The general election steering group office is located in the civil affairs department of the people's government at the same level. The main responsibilities of the eighth village committee election work steering group:

(a) to publicize the relevant laws, regulations and policies;

(two) to formulate the work plan for the general election and organize its implementation;

(3) Organizing the training of election staff;

(four) to accept reports and letters and visits about the general election work;

(five) other matters to guide the election work. Article 9 election of villagers committee is established in the village.

Members of election of villagers committee are composed of five to nine directors and members. Members should be representative, elected by villagers' meetings, villagers' representative meetings or villagers' group meetings, and reported to the steering group for the general election of villagers' committees in townships, nationality townships and towns for the record.

Election of villagers committee presided over the general election of the village committee under the guidance of the steering group for the general election of the village committee in townships, nationality townships and towns.

Election of villagers committee should elect a director to preside over the work of election of villagers committee. Article 10 election of villagers committee shall perform the following duties:

(a) to carry out election propaganda and mobilization, and to answer questions raised by villagers about the election;

(two) to formulate the implementation plan of the election work and submit it to the villagers' meeting or the villagers' representative meeting for discussion and decision;

(three) to determine and train election staff;

(four) audit, registration and publication of the list of villagers to participate in the election;

(five) organize the villagers registered to participate in the election to produce candidates according to law and publish the list of candidates;

(six) announced the election time, place and procedure;

(seven) review the proxy voting, voting power of attorney, and publish the list of clients and clients;

(8) Electing the tellers, scrutineers and tellers, organizing voting, announcing the election results, and reporting them to the steering group for the election of villagers' committees in townships, nationality townships and towns for the record;

(nine) to summarize and report the election work, and organize the establishment of election work files;

(ten) to accept the opinions and complaints of the villagers;

(eleven) to preside over the transfer of the villagers' committee;

(twelve) responsible for handling other matters related to the election. Eleventh after the expiration of the term of office of a village committee, the general election shall be held according to the date determined by the steering group for the general election of the village committee at the county level. The advance or postponement of the general election shall not exceed three months.

If the villagers' committee postpones the general election for more than three months, the people's governments of townships, nationality townships and towns shall be responsible for convening the villagers' meeting, and the villagers' committee shall be elected by the villagers' meeting to conduct the general election according to law. Twelfth local people's governments at all levels to guide the election of villagers' committees, according to the financial management system by the financial expenses. Chapter III Registration of Villagers to Participate in Elections Article 13 Villagers who have reached the age of 18 have the right to vote and stand for election, except those who are deprived of political rights according to law. Fourteenth before the election of a villagers' committee, the following persons shall be registered and included in the list of villagers participating in the election:

(a) the household registration in the village and the villagers living in the village;

(two) the household registration in the village, not living in the village, I said to participate in the village election;

(3) If the household registration is not in the village and has lived in the village for more than 1 year, and I apply to participate in the election, I shall provide the villagers' certificate issued by the village (neighborhood) committee where the household registration is located that did not participate in the election of the village (neighborhood) committee and agreed to participate in the election by the villagers' meeting or the villagers' representative meeting.

The age of villagers is calculated on the election day, the date of birth is based on the date recorded in the resident ID card, and the date recorded in the household registration book is based on the date without the resident ID card.
