Chapter I General Provisions

Article 1 In order to further promote the exchange of customs anti-smuggling police cadres, strengthen the team building, improve the quality of cadres, and establish a team of customs anti-smuggling police cadres with firm politics, exquisite professional skills, strict discipline, excellent work style and integrity, these Provisions are formulated in accordance with the relevant provisions of the Party and the state, the Regulations on the Exchange of Cadres in the Customs System, and the actual work of the customs anti-smuggling department.

Article 2 The customs shall follow the following principles in exchanging anti-smuggling police cadres:

(a) combined with the training of cadres;

(two) combined with optimizing the leadership structure and giving full play to the advantages of cadres;

(three) combined with the implementation of the tenure system of leading cadres and the post avoidance system;

(4) To meet the needs of anti-smuggling work;

(five) combined with strengthening the construction of a clean government.

Chapter II Ways of Communication

Article 3 The communication methods between customs anti-smuggling police are divided into internal communication and external communication.

Article 4 Communication within the customs system includes communication within the customs area and communication across customs areas.

(1) Communication within the customs area refers to the communication between the anti-smuggling departments of the customs anti-smuggling police and between the anti-smuggling departments and other customs departments within the same directly affiliated customs unit.

(2) Cross-border communication refers to the communication between different directly affiliated customs units and between directly affiliated customs units and organs of the General Administration.

Article 5 The communication outside the customs system refers to that the customs anti-smuggling police cadres go to the local places for temporary training.

Chapter III Communication Objects

Article 6 The exchange targets of customs anti-smuggling police cadres are mainly leading cadres at all levels of customs anti-smuggling police.

Article 7 In any of the following circumstances, communication must be conducted:

(1) Having served as the director or political commissar of the anti-smuggling bureau directly under the same customs for 8 years;

(2) Served as deputy director of the Anti-smuggling Bureau directly under the Customs 10 year;

(3) Having worked in the same position for 6 years in the office directly under the Customs Anti-smuggling Bureau or under the leadership of the Customs Anti-smuggling Bureau;

(4) Directly under the Customs Anti-smuggling Bureau or under the 9-year-old "Jiao Zhijian Ping Dou"? Sell your words? Are you still there? Year;

(five) according to the relevant provisions of the Central Committee and the State Administration of posts that need to be avoided;

(six) other reasons that must be communicated.

Article 8 In any of the following circumstances, it shall be exchanged in a planned way:

(1) Having served as the director, political commissar and deputy director of the anti-smuggling bureau directly under the same customs for more than 5 years;

(2) The leaders of the office directly under the Customs Anti-smuggling Bureau, the leaders of the Customs Anti-smuggling Branch, and the leaders of the department-level institutions within the above-mentioned institutions have worked in the same post for more than 3 years;

(3) Other reasons for communication.

Article 9 Generally, the following persons will no longer conduct cross-border communication:

(1) The leading cadres at the deputy bureau level are over 55 years old;

(two) the leading cadres at the department level are over 50 years old;

(three) the leading cadres below the department level are over 45 years old.

Special circumstances need to communicate, in accordance with the customs anti-smuggling police cadres management authority shall be determined separately.

Article 10 In any of the following circumstances, the Exchange will suspend trading:

(a) determined to be incompetent after examination;

(two) due to health reasons can not adhere to the normal work;

(three) suspected of violating discipline and law, is under organizational review and has not yet reached a conclusion;

(4) Professional posts or special needs of anti-smuggling work.

Eleventh cadres who no longer communicate or suspend communication according to regulations should adjust their work according to different situations.

Article 12 Cadres who exchange from other customs departments to anti-smuggling departments must meet the conditions for the first award of police ranks of the people's police and be awarded corresponding police ranks in accordance with relevant regulations; Cadres who exchange from the anti-smuggling department to other customs departments shall retain their police ranks during the exchange and shall not be promoted.

Chapter IV Communication Time Limit

Thirteenth customs anti-smuggling police cadres exchange period in principle in accordance with the provisions of the tenure system for leading cadres.

Fourteenth cross-border communication time limit according to the following standards:

(a) deputy bureau level leading cadres are generally 4 years;

(two) the leading cadres at the department level and section level are generally 3 years;

(three) other cadres are generally 2 years;

(4) The communication period between the customs in coastal areas and the customs in border minority areas is generally 3 years; Generally speaking, the communication cycle between customs in remote inland areas and customs in coastal areas is 1 year.

Fifteenth customs anti-smuggling police cadres who exercise outside the system generally have a term of two years.

Sixteenth due to work needs or special circumstances, can be appropriately extended or shortened the cadre exchange cycle.

Chapter V Organization, Implementation and Management

Article 17 The exchange of customs anti-smuggling police cadres shall be conducted under the leadership of the party group, and the cadres shall be responsible at different levels according to their management authority, which shall be organized and implemented by the personnel department.

(1) The exchange of management cadres of the General Administration of Customs shall be reported to the Education and Education Department by the Party Group of the General Administration of Customs and the Anti-smuggling Bureau of the General Administration of Customs, and the Education and Education Department shall report it to the Party Group of the General Administration of Customs after studying it; Cross-customs exchanges shall be put forward by the party group of the Customs Anti-smuggling Bureau directly under the General Administration of Customs and reported to the Education Department, which shall report to the party group of the General Administration of Customs after studying;

(2) The exchange of management cadres of the Anti-smuggling Bureau of the General Administration of Customs shall be proposed by the Party Group of the Anti-smuggling Bureau directly under the Customs, and reported to the Party Group of the Anti-smuggling Bureau of the General Administration of Customs for examination and approval after being approved by the Party Group directly under the Customs;

(3) The exchange of cadres directly under the Customs shall be proposed by the Party Group of the Customs Anti-smuggling Bureau directly under the Customs and reported to the Party Group directly under the Customs for examination and approval, and the exchange of heads of divisions (divisions and teams) within the Customs Anti-smuggling Bureau directly under the Customs requires the prior consent of the Party Group of the Anti-smuggling Bureau of the General Administration;

(four) the exchange of management cadres directly under the Customs Anti-smuggling Bureau shall be put forward by the Political Department of the Customs Anti-smuggling Bureau directly under the Central Committee and reported to the Party Group of the Customs Anti-smuggling Bureau directly under the Central Committee for approval. Need to communicate in the customs area, shall go through the formalities for examination and approval in accordance with the relevant provisions;

(five) the exchange of cadres above, but also in accordance with the cadre management authority, by the party group with the power of examination and approval of cadres and relevant departments and units to make a decision. If consent is required in accordance with regulations, a decision shall be made after obtaining consent.

(6) If the cadres of other departments directly under the Customs need to communicate with the anti-smuggling department, it shall be handled in accordance with the administrative authority of the anti-smuggling police cadres of the Customs.

Article 18 The exchange of leading cadres of the customs anti-smuggling police shall be conducted in strict accordance with the relevant provisions on the number of posts of leading bodies, and shall not exceed the number of posts.

Article 19 The assessment of cadres exchanged by the customs anti-smuggling police in the customs system shall be organized and implemented according to the cadre management authority, and the unit to which they belong shall be responsible. If the communication is less than half a year, it can be assessed in the original unit; Cadres transferred to the customs system, in addition to participating in the annual assessment of the attachment unit, will also be in the attachment period and after the expiration of the attachment period, the General Administration will conduct a special assessment in conjunction with the attachment unit.

Twentieth exchange cadres should take office within half a month after receiving the exchange notice.

Twenty-first exchange cadres to the new work unit, should go through the administrative and party, League relations transfer procedures, not to transfer wages, household registration and personal files.

Article 22 If an exchange cadre is promoted during the exchange, it shall be handled by the current unit in accordance with the cadre management authority, but the opinions of the original unit of the cadre shall be sought before the examination and approval, and the relevant materials such as the appointment notice shall be copied to the original unit in time. If it is necessary to change the wage standard, the unit where the wage relationship is located shall be responsible for handling it, and report it to the competent department cadres and the management cadres of the Anti-smuggling Bureau of the General Administration for examination and approval.

Twenty-third exchange leading cadres who implement the tenure system need to write a report on their tenure work two months before the expiration of their tenure, and report their tenure work at the customs (bureaus and offices) meeting. The main person in charge of the unit above the division level shall also accept the outgoing audit and mass appraisal of the unit. The work report of the term of office and the opinions of the masses are summarized and reported to the personnel department of the higher authorities for the record. According to the management authority of the cadres, after the inspection by the personnel department, the party group is reported to decide whether to be re-elected or adjusted.

Article 24 When the exchange of other cadres expires, they shall summarize the work during the exchange, fill in the Examination Form for the Exchange of Police Cadres in the Customs Anti-smuggling (see Annex), and organize personnel to evaluate the work during the exchange within a certain scope according to the cadre management authority. According to the appraisal situation, make an appraisal of their political thoughts and work performance during the exchange period, and report to the personnel department of the higher authorities for the record according to the cadre management authority.

Twenty-fifth exchange cadres during the exchange, I asked to resign, I submitted a written application, according to the cadre management authority for examination and approval, without approval shall not leave.

Twenty-sixth exchange cadres during the exchange, in case of rewards and punishments, according to the relevant provisions of the General Administration and the cadre management authority, approved by the current unit or reported to the higher authorities, and timely feedback to the original unit of cadres.

Chapter VI Supporting Measures

Twenty-seventh cross-border exchange cadres' wages, allowances, bonuses, welfare benefits, etc. shall be borne by the original unit in accordance with the principle of "high is not low, not repeated enjoyment". If the original unit area standard is lower than the current unit area standard, the difference will be paid by the current unit. The daily benefits in kind and local subsidies for exchange cadres shall be paid by the current unit according to the standards of cadres at the same level.

Twenty-eighth exchange cadres travel, accommodation, medical expenses and other expenses, by the current unit in accordance with the provisions of reimbursement.

Cadres who exchange across customs areas shall enjoy food subsidies according to the relevant provisions of the Ministry of Finance. If the local standards are higher than the prescribed standards, the local standards shall prevail. The food allowance for the exchange cadres in the customs area shall be determined by the units directly under the customs according to the actual situation.

Exchange cadres in the original unit for basic medical insurance and according to the relevant provisions of the local medical reform for remote medical procedures or transfer of basic medical accounts, serious illness medical expenses by the current unit in accordance with the provisions of reimbursement; The original unit has not yet handled the basic medical insurance, and the medical expenses shall be reimbursed by the current unit according to the regulations; Now the unit has not yet handled the basic medical insurance, and the medical expenses shall be reimbursed by the unit in accordance with the relevant provisions.

Twenty-ninth cadres who exchange to the customs in Lhasa and other plateau and cold areas shall be given appropriate subsidies at one time by the original unit. Among them, the post salary of cadres who exchange to Lhasa customs area rises to a higher level during the exchange period, and can be converted into fixed salary after 4 years of exchange.

Thirtieth cross-border exchange cadres enjoy family leave in accordance with the regulations. Family leave can be taken at one time, or combined with national statutory holidays, but generally not more than three times a year. The transportation expenses for visiting relatives shall be reimbursed by the current unit according to regulations; If the cadre himself has not taken a vacation, his spouse's travel expenses for visiting relatives can be reimbursed by the cadre's current unit.

Thirty-first cross-border exchange cadres' housing, living equipment, rent, utilities and other expenses shall be handled in accordance with the relevant provisions of the Notice of the General Administration of Customs on Solving the Problems of Living Rooms for Exchange Cadres (No.273 [2000] of the Department of Finance).

Thirty-second leading cadres at all levels and organizations and personnel departments should earnestly care about cadre exchanges and help solve worries. If it is difficult to exchange cadres' family life, appropriate subsidies may be given as appropriate; If children have difficulties in entering school or finding employment, the original unit should try its best to help solve them within the scope permitted by the policy.

Thirty-third after the expiration of the exchange of cadres, the original unit should make timely and proper arrangements. Cadres who have worked in hard areas and made outstanding achievements should be given priority in promotion and use.

Chapter VII Discipline and Law

Article 34 The Anti-smuggling Bureau directly under the Customs shall strictly implement the regulations and procedures for the exchange of cadres. Individuals or a few people are not allowed to specify the communication object, and it is not allowed to promote cadres by surprise through communication. It is not allowed to use exchanges to retaliate against cadres, exclude dissidents, and form gangs. Offenders will be severely punished.

Article 35 The Anti-smuggling Bureau directly under the Customs and leading cadres at all levels must establish the concept of the overall situation, and shall not refuse or obstruct the higher authorities to select or mobilize exchange cadres, and offenders will be severely dealt with.

Thirty-sixth leading cadres at all levels must establish a sense of communication, strictly abide by the communication regulations, and refuse to obey the communication decision without special reasons, and be dismissed.

Thirty-seventh cadres after the exchange, shall not take away staff and public goods such as means of transportation and communication from the original unit.

Chapter VIII Supplementary Provisions

Article 38 The Anti-smuggling Bureau of the General Administration shall be responsible for the interpretation of these Provisions.

Article 39 These Provisions shall come into force as of the date of promulgation. Where other provisions are inconsistent with these Provisions, these Provisions shall prevail.
