1. Institutions organized by state organs or other organizations using state-owned assets for the purpose of social welfare, including those whose funds are mainly allocated by the government, partly supported by the government and raised by themselves, shall implement post setting management in accordance with the Trial Measures and these implementation opinions.

If the post setting management involves the leaders of public institutions, it shall be implemented in accordance with the relevant provisions of the cadre personnel management authority.

3. All kinds of societies, associations, foundations and other social group work personnel who use the career establishment shall be included in the post setting management with reference to the "Trial Measures" and the implementation opinions.

4. The trial measures and implementation opinions are not applicable to institutions and social organizations managed by reference to the Civil Service Law of People's Republic of China (PRC), institutions and enterprises with independent accounting owned by various enterprises, and units transformed from institutions into enterprises.

Second, the post category setting

5. According to the social function, responsibilities and tasks, work nature and personnel structure characteristics of public institutions, comprehensively determine the structural proportion of the total number of management posts, professional and technical posts and ground-working skills posts (hereinafter referred to as the three types of posts) of public institutions.

6. The structural proportion of the three types of posts in public institutions shall be determined by the personnel administrative department of the government and the competent department of public institutions, and the control standards are as follows:

(1) Institutions that provide social welfare services mainly with professional skills should ensure that professional and technical posts are the main body, generally not less than 70% of the total number of posts in their own units.

(2) institutions that are mainly responsible for managing social affairs should ensure that management posts are the main body, which should generally account for more than half of the total number of posts in their own units.

(3) institutions mainly responsible for skill operation and maintenance, service guarantee, etc. We should ensure that ground skills posts are the main body, which should generally account for more than half of the total number of posts in this unit.

(4) The other two types of posts other than the main posts of public institutions should maintain a relatively reasonable structural proportion.

13. The structural proportion between high, middle and junior professional and technical posts and between different levels of posts within high, middle and junior professional and technical posts shall be controlled according to the development level of regional economic and social undertakings and industry characteristics, as well as the functions, specifications, affiliation and professional and technical level of institutions.

The structural ratio among senior, middle and junior professional and technical posts is 1: 3: 6.

14. 20. The establishment of ad hoc posts shall be audited by the competent department and reported to the personnel administrative department of the government at or above the municipal level for approval.

All regions and departments should formulate specific management measures according to the actual situation.

Fourth, the basic conditions of the post

(A) the basic conditions of each post

2 1. The basic conditions of management posts, professional and technical posts and ground skills posts in public institutions are mainly determined according to the responsibilities, tasks and qualifications of the posts. Basic conditions for three types of posts in public institutions:

26. The basic conditions of professional and technical posts subject to occupation qualification access control shall include the requirements of access control.

28. 30. The post setting scheme of institutions directly under the State Council shall be implemented after being approved by the Ministry of Personnel.

3 1. The post setting scheme of institutions directly under the government of all provinces (autonomous regions and municipalities directly under the Central Government) shall be reported to the local personnel department (bureau) for approval.

34. If vertical management is implemented in institutions directly under the State Council, the implementation plan for post setting management of institutions shall be reported to the Ministry of Personnel for the record, and shall be organized and implemented by institutions directly under the State Council.

For the institutions directly under the provincial vertical management, the post setting implementation plan of the institutions shall be submitted to the personnel department (bureau) of the province (autonomous region, municipality directly under the Central Government) for approval, and shall be organized and implemented by the institutions directly under the Central Government.

Sixth, post employment

35. Institutions shall, in accordance with the "Trial Measures" and the implementation opinions, industry guidance and the approved post setting scheme, determine specific posts, clarify post grades, hire staff and sign employment contracts in accordance with the principles of setting posts according to needs, competing for posts and staffing by posts.

36. Institutions shall employ personnel in strict accordance with the responsibilities, tasks and qualifications of the post and in accordance with the requirements of not less than the basic conditions stipulated by the state. Those who are truly talented, knowledgeable, in urgent need of posts and meet the conditions of abnormality can be employed according to relevant regulations.

37. Institutions that have not yet implemented the employment system and post management system should pay close attention to post setting, implement the employment system and organize post employment in accordance with the spirit of the Notice of the General Office of the State Council on Forwarding the Opinions and Trial Measures of the Ministry of Personnel on the Trial Employment System in Institutions, the Implementation Opinions and the Industry Guidance Opinions.

Institutions that have implemented the employment system and signed employment contracts may, according to the requirements of the Trial Measures, implementation opinions and industry guidance, determine different levels of posts for their existing personnel in accordance with the approved post setting scheme, and change the corresponding contract contents.

38. The personnel administrative department of the government and the competent department of public institutions shall identify the situation that public institutions have completed post setting, organized post employment and signed employment contracts. For those who meet the policy requirements and complete the standardized post setting and post employment, the post salary shall be determined according to the employment position.

39. The personnel administrative departments of governments at all levels, the competent departments of public institutions and public institutions shall, in accordance with the relevant provisions of the state, make the existing registered official staff of public institutions enter posts of corresponding grades according to their current positions or posts.

All regions, departments and institutions should strictly grasp the policies, and shall not break through the existing posts in violation of regulations, and shall not assault employees or posts. Measures should be taken to strictly limit the establishment of senior positions in senior, middle and junior professional and technical positions.

40 institutions set up posts and employment posts for the first time, and the proportion of post structure shall not exceed the proportion of existing personnel. If the existing personnel structure ratio has exceeded the approved structure ratio, it shall gradually reach the prescribed structure ratio through natural attrition, transfer, low employment or dismissal. Seven, professional and technical posts

4 1. The first-level professional and technical post is a special post set by the state.

Eight, organize the implementation

44. The personnel administrative departments of governments at all levels, as the comprehensive management departments of post setting management of public institutions, should strengthen policy guidance, macro-control and supervision and management in accordance with the requirements of the Trial Measures and the Implementation Opinions. It is necessary to give full play to the functional role of the relevant competent departments, and do a good job in organizing the implementation of post setting management in strict accordance with the approved standards for the proportion of various post structures.

45 institutions shall, in accordance with the relevant provisions of the post setting management, independently set up various specific posts of their own units and clarify the post grades. The personnel administrative department of the government and the competent department of public institutions shall implement the autonomy of the employing units, and ensure that public institutions independently employ personnel according to their job responsibilities, tasks and qualifications.

46. If the industry has guidance on post setting, do a good job in post setting management of public institutions in accordance with the "Trial Measures", implementation opinions and industry guidance; You can refer to the guidance of industry post setting, and with the consent of the government personnel administrative department, you can refer to the guidance of similar industries; The post setting of other institutions shall be implemented by the personnel administrative department of the government in conjunction with the competent department of institutions in accordance with the "Trial Measures" and the spirit of this implementation opinion.

47. Encourage qualified regions, departments and institutions to establish a database of post setting management information, and use computer information technology to improve the informationization and standardization level of post management in institutions.

48. All regions, departments and institutions should strictly implement relevant policies and regulations, adhere to principles and adhere to the mass line in job setting and job recruitment. In violation of the provisions of the abuse of power, take revenge, abuse of power for personal gain, to be held accountable. For institutions that do not set posts and employ posts according to the "Trial Measures" and the implementation opinions, the personnel administrative department of the government and relevant departments will not confirm the post level, will not cash wages, and will not allocate funds. If the circumstances are serious, informed criticism shall be given to the relevant leaders and responsible persons, and corresponding disciplinary action shall be given according to the personnel management authority.

49. The personnel departments (bureaus) of all provinces (autonomous regions and municipalities directly under the Central Government), the ministries and commissions of the State Council and the personnel departments of all directly affiliated institutions shall, in light of the actual situation, formulate specific implementation opinions on post setting management in their respective regions and departments according to the Trial Measures, Implementation Opinions and industry guidance, and report them to the Ministry of Personnel for the record and organize their implementation.

50. The personnel department is responsible for the interpretation of this implementation opinion.

Career establishment is not a civil servant.
