Enlightenment from Brazil-America Cotton Subsidy Case
On June 8, 2004, the WTO Dispute Settlement Body ruled that American cotton subsidies violated WTO rules. Most of Brazil's claims that American cotton subsidies violate WTO rules are supported. At present, the United States has appealed, and the appeal result will be announced within three months. Whatever the outcome, this is an unprecedented event in the history of WTO: subsidies for bulk agricultural products entered and passed the trade dispute settlement mechanism.

Agricultural subsidies are mainly transfer payments for agricultural production, circulation and trade. In other words, agricultural producers receive subsidies from the government budget to achieve the income target of the agricultural sector and make up for the lack of income distribution in the free market. In the field of international trade, due to the basic position of agriculture, the WTO Agreement on Agriculture allows subsidies for bulk agricultural products, but such subsidies are limited, and the WTO has also stipulated clear disciplines. If members violate these disciplines, they will be bound accordingly. Brazil v. United States cotton subsidy case is the result of the United States ignoring these disciplines. Cotton is the king of American agriculture and one of the most subsidized agricultural products in the United States. There are many subsidy schemes, including direct subsidies and export credit guarantees. Most of them violated WTO rules and were also subsidies involved in the case of Brazil v. United States cotton subsidies, and Brazil finally won the case. As the first lawsuit against domestic agricultural subsidies in the history of WTO (including GATT), it has far-reaching significance. It has injected new elements into agricultural subsidies under the framework of WTO.
