Legal basis: Regulations on Commending Martyrs
Thirteenth survivors of martyrs who meet one of the following conditions enjoy regular pensions:
(a) the parents, dependents and spouses of martyrs have no ability to work, no source of income, or their income level is lower than the average living standard of local residents;
(2) The children of martyrs are under 18 years old, or have reached 18 years old, but have no source of livelihood due to disability, school and other reasons;
(3) The brothers and sisters supported by the martyrs during their lifetime are under 18 years old, or have reached 18 years old but have no source of livelihood because they are attending school.
Survivors of martyrs who meet the conditions specified in the preceding paragraph and enjoy regular pensions shall receive a certificate of receiving regular pensions from the civil affairs department of the people's government at the county level where their household registration is located.
Nineteenth martyrs' children, brothers and sisters voluntarily, and meet the conditions for conscription, under the same conditions, give priority to their active service. Children of martyrs who meet the requirements of the civil service examination will be given priority as civil servants under the same conditions.
Children of martyrs receive pre-school education and compulsory education and are given preferential treatment in accordance with relevant state regulations; Those who receive preschool education in public kindergartens are exempt from teaching fees. Children of martyrs apply for graduate students in ordinary high schools, secondary vocational schools and institutions of higher learning, and priority is given to admission under the same conditions.
Those who apply for undergraduate and junior college in ordinary colleges and universities may lower their scores in accordance with the relevant provisions of the state; Those who study in public schools are exempt from tuition and fees and enjoy various subsidy policies stipulated by the state.
If the survivors of martyrs meet the employment conditions, the local people's government in Ministry of Human Resources and Social Security will give priority to providing employment services. If the survivors of martyrs have been employed, the employer shall give priority to retaining them when making economic layoffs. Survivors of martyrs engaged in self-employed, industry and commerce, taxation and other departments should give priority to apply for licenses, and survivors of martyrs enjoy preferential policies stipulated by the state and local people's governments during their operation.
