Compensation standard for students' fracture in school
When a student has a fracture at school, he must first be identified as a person with no civil capacity, limited capacity or full capacity. 1. If he is a person without civil capacity, the school shall bear the tort liability; However, if the school can prove that it has fulfilled its educational management responsibility, it will not bear tort liability; 2. He is a person with limited capacity for civil conduct. If he has a fracture at school and the school fails to fulfill his educational management duties, he shall bear tort liability; 3. If he is a person with full capacity for civil conduct, such as a college student's fracture at school, he is responsible for his own reasons and the school is responsible for his own reasons.

Secondly, the compensation standards for fractures during school include medical expenses, nursing expenses, transportation expenses, nutrition expenses, hospital food subsidies and other reasonable expenses for treatment and rehabilitation.

Legal basis: Article 1 199 of the Civil Law of People's Republic of China (PRC) stipulates that kindergartens, schools or other educational institutions shall bear tort liability if a person without civil capacity suffers personal injury during his study and life in kindergartens, schools or other educational institutions; However, those who can prove that they have fulfilled their educational management responsibilities will not bear tort liability.

Article 1200 of the Civil Law of People's Republic of China (PRC) stipulates that if a person with limited capacity for civil conduct suffers personal injury during his study and life in a school or other educational institution, and the school or other educational institution fails to fulfill its educational management duties, he shall bear tort liability.

Article 179 of the Civil Law of People's Republic of China (PRC) stipulates that if personal injury is caused by infringement on others, it shall be reasonable expenses for treatment and rehabilitation, such as medical expenses, nursing expenses, transportation expenses, nutrition expenses, hospital food subsidies, etc. And compensate for the reduced income due to absenteeism. If it causes disability, it shall also compensate for the cost of assistive devices and disability compensation; If death is caused, funeral expenses and death compensation shall also be paid.
